1. General provisions
1.1.
These general conditions of sale (hereinafter General Conditions) apply to all online sales of RUDY PROFUMI SRL products (hereinafter Products or Product) made through the site www.rudyprofumi.it (hereinafter the Site).
1.2.
The online selling services described in these General Conditions are available only to consumers (hereinafter Customers or Customer), i.e. natural persons acting for purposes unrelated to their commercial, entrepreneurial, craft and professional activity, over the age of 18 (or, if minors, duly authorized by their legal representative).
1.3.
The language used to conclude any contract through this Site is Italian or English.
1.4.
Customers are required to carefully read the General Conditions, which have been made available on the Site to allow Customers to view, archive and reproduce them.
1.5.
Each purchase is governed by the General Conditions on the Site at the time the Customer completes the procedure for sending the order. Contracts with Customers will be archived by RUDY PROFUMI SRL with access for Customers from the Site through their account.
2. Identification of the seller
2.1.
The seller is RUDY PROFUMI SRL, with registered office in via Einstein 4 (20090) ASSAGO - MILAN, VAT number 08000970155 - p.e.c .: pec@pec.rudyprofumi.com
3. Information on products and their availability
3.1.
The information on the Products, together with the related product codes, are available on the Site.
3.2.
The Site does not contain all the Products of RUDY PROFUMI SRL. The Products available on the Site are a selection of items. The representations of the Products displayed on the Site may not correspond to their actual appearance.
3.3.
All Products are subject to availability. RUDY PROFUMI SRL reserves the right at any time to change the limits of quantity and / or type of Products available online from the Site. The style, models and colors of the Products described on the Site may be changed without notice. During the process of completing the transaction, an automatic response will inform the Customer if the order cannot be fulfilled due to the unavailability of the ordered Product.
3.4.
Some products may be sold with the pre-order formula. This means that the products are custom made and the production time will take around six weeks.
4. Price
4.1.
The prices of the Products are indicated on the Site in euros and include VAT, but do not include any taxes, duties and levies applicable in the country of destination of the Products, when this is different from Italy. These costs, which differ from country to country, are charged to the Customer, who is responsible for verifying the amount with the competent customs authorities. Delivery costs are added to the price of the Products and are indicated separately on the order form.
4.2.
The information displayed on the Site does not represent an offer by RUDY PROFUMI SRL.
5. Purchases
5.1.
Before submitting an order proposal, the Customer must make sure that he has read and understood all the information provided during the purchase procedure, together with the General Conditions present on the Site at that time, as he will be bound by them, once concluded the contract.
5.2.
To purchase a Product, the Customer must fill in an order proposal and send it to RUDY PROFUMI SRL through the Site. The Customer must insert the Product in his cart and, after reading and accepting the General Conditions, as well as after having read the 'privacy policy, must select the desired payment method and choose the order option.
5.3.
The Customer can correct any errors in the data he has entered, before sending the order proposal, by following the procedure provided on the Site. In particular, he can change the quantity of Products he intends to purchase, adding or removing one or more Products from his own shopping cart.
5.4.
By sending an order proposal to RUDY PROFUMI SRL, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions.
5.5.
Without prejudice to the provisions of the privacy policy regarding the use of personal data, the order proposal and Customer data relating to it may be archived by RUDY PROFUMI SRL for the period required by applicable law.
6. Methods of payment
6.1.
Customers can pay for the Products and the related delivery costs with the payment methods expressly indicated on the Site.
6.2.
If, for any reason, it is not possible to debit the amounts due by the Customer, the transaction will be interrupted, and the sale canceled.
7. Contract closure
7.1.
The contract between RUDY PROFUMI SRL and the Customer is finalized when the Customer receives confirmation from RUDY PROFUMI SRL, via e-mail, that his order proposal, transmitted through the procedure indicated on the Site, has been successfully concluded.
8. Transport and delivery
8.1.
The Products purchased on the Site will be delivered to the address indicated in the order. At the time of delivery, the signature of the Customer or of an adult delegated by the Customer will be required. RUDY PROFUMI SRL cannot deliver to post office boxes.
8.2.
The shipment is arranged only after receipt of the payment by RUDY PROFUMI SRL.
8.3.
For each order, RUDY PROFUMI SRL will make the due registration in the payment register. The invoice will be issued only at the express request of the Customer at the time of the order.
8.4.
Delivery costs are charged to the Customer and are indicated separately in the order form.
8.5.
All purchases will be delivered by a courier, chosen by RUDY PROFUMI SRL (hereinafter Courier), from Monday to Saturday, excluding Sundays and local or national holidays, starting from the day following the availability of the goods for shipment. RUDY PROFUMI SRL is not responsible for unforeseeable delays and/or delays attributable exclusively to the Courier.
8.6.
Unless events of force majeure or unforeseeable circumstances occur, the Products must be delivered within 30 (thirty) days from the date of closure of the contract referred to in Paragraph 7 above.
8.7.
If, following the communication of RUDY PROFUMI SRL of a delay in delivery, beyond the deadline referred to in point 8.6, the Customer wishes to cancel the order, any amount already paid by the Customer will be reimbursed as soon as possible, in any case no later than fourteen days from the date of receipt of the Customer's communication of cancellation of the order, except for customized Products, subject to the following Paragraph 10.
8.8.
The Customer or his/her delegate must be present at the delivery address indicated in the order of the Products and, at the time of delivery by the Courier, is required to check: (i) that the number of items delivered corresponds to that indicated on the delivery note and (ii) that the packaging and its seals are intact, not damaged, not wet or otherwise altered. Any damage to the packaging and/or the Product visible on delivery, or discrepancies in the number of packages or in the documentation must be immediately reported in writing on the Courier's delivery note. Once the Courier's document has been signed without dispute by the Customer, the Customer will not be able to make any objection about the external characteristics of the delivered package.
8.9.
RUDY PROFUMI SRL will send the Customer a confirmation e-mail, once the Products have been shipped.
9. Packaging
9.1.
The Products purchased on the Site are delivered with standard packaging, regularly used by RUDY PROFUMI SRL.
10. Customized products
10.1.
Pursuant to art. 59 Legislative Decree no. 206/2005 (Consumer Code) the right of withdrawal, which would otherwise be available, does not apply to orders for customized Products, such as, for example, those with the Customer's initials engraved on the Product or pre-ordered products. The Customer is aware that the images on the Site do not necessarily correspond to reality: the images and photographs of the engraving may not reflect the real aspect of the final product.
11. Right of withdrawal
11.1.
RUDY PROFUMI SRL seeks the complete satisfaction of its Customers. The Customer has the right to withdraw from the contract without specifying the reason, by returning the Products purchased on the Site within fourteen days from the date of receipt of the Products, pursuant to art. 52 of the Consumer Code. This applies to all Products other than customized ones, which are subject to Paragraph 10.
11.2.
To exercise the right of withdrawal, the Customer must send an e-mail to shop@rudyprofumi.com, containing: the indication of his/her intention to exercise the right of withdrawal; the indication of the Products for which he/she intends to exercise the right of withdrawal; the order number; and, if the Customer has purchased the Products by bank transfer, the Customer's bank details on which to make the refund.
11.3.
With the exercise of the right of withdrawal, RUDY PROFUMI SRL will refund the full price of the Products on condition that they are returned by the Customer intact, unused and undamaged, in the original packaging. RUDY PROFUMI SRL reserves the right to refuse returns of Products that do not comply with these requirements.
11.4.
Refunds will be made with the same payment method used for the purchase.
11.5.
The costs of returning the Products are charged to the Customer. Any cost incurred by the Customer for returning the Products is non-refundable.
11.6.
The Customer must return the Products to the seller or to a third party authorized by the seller to receive them, without undue delay and in any case within fourteen days from the date on which he/she communicated to the seller his/her decision to withdraw from the contract. The deadline is met if the Customer sends the goods before the expiry of the fourteen-day period.
11.7.
RUDY PROFUMI SRL undertakes to reimburse the Customer, within fourteen days from the date of receipt of the Customer's notice of cancellation of the order, but, pursuant to art. 56 of the Consumer Code, reserves the right to withhold the refund until it has received the goods, or until the Customer has demonstrated that he/she has returned the goods, whichever occurs first.
11.8.
RUDY PROFUMI SRL will send an email notification, once the refund has been made.
11.9.
It is advisable to return the Products by courier, insuring the full value of the item and using a traceable shipping service. RUDY PROFUMI SRL cannot be held responsible for the reimbursement or compensation of Products returned but not received by RUDY PROFUMI SRL due to loss, theft, or damage not attributable to RUDY PROFUMI SRL.
12. Product defects
12.1.
If a Product sold by RUDY PROFUMI SRL presents manufacturing defects or a lack of conformity, the Customer must contact the Customer Service as soon as possible via e-mail to shop@rudyprofumi.comand in any case report the defect within two months of discovery. The complaint is not necessary if the seller has acknowledged the existence of the defect or has concealed it.
12.2.
In case of lack of conformity, the Customer has the right to have the Product repaired or replaced. The reduction of the price and the termination of the sales contract are, however, applicable remedies (a) when the seller has not completed the repair or replacement, or when the seller has refused to restore the conformity of the goods; (b) when a lack of conformity remains despite the seller having tried to restore the conformity of the goods; (c) when the lack of conformity is so serious as to justify the immediate reduction of the price or the termination of the sales contract; or (d) when the seller has declared that it will not restore conformity of the goods or in any case has not restored conformity within a reasonable time, or without significant inconvenience to the Customer. If the lack of conformity is minor (with the burden of proof being borne by the seller), the Customer has no right to terminate the contract, however he/she can refuse to pay the price or part of it, until the seller has remedied the lack of conformity(articles 135-bis and following of the Consumer Code).
13. Errors or inaccuracies
13.1.
RUDY PROFUMI SRL undertakes to provide updated information in the sections of the Site relating to the description and / or sale of the Products. However, RUDY PROFUMI SRL cannot guarantee that the Site is error-free. The Site in question may contain typing errors, inaccuracies or omissions, for example relating to the price or availability of the Product or to the information provided on the Product. RUDY PROFUMI SRL reserves the right to correct such errors, inaccuracies or omissions, as well as the right to change or update information at any time, without notice.
14. Guarantee of authenticity and intellectual property rights
14.1.
RUDY PROFUMI SRL guarantees the authenticity of all Products purchased on the Site. The Products bearing the RUDY PROFUMI SRL brand are MADE IN ITALY.
14.2.
The RUDY PROFUMI SRL brand, together with all the figurative and non-figurative trademarks, service marks, present in the Products, in the related accessories and / or packaging, subject to registration or not, together with all the illustrations and images protected by the right of the author, and more generally all intellectual property rights relating to the Products, are and remain the exclusive property of RUDY PROFUMI SRL.
15. Applicable law and competent court
15.1. These General Conditions are governed by Italian law. For what is not expressly provided for here, Legislative Decree no. 206 of 6 September 2005 and subsequent amendments, "Consumer Code" and the Legislative Decree n. 70 of April 9, 2003, "E-commerce Decree" are applicable.
15.2.
ny dispute arising from the interpretation, validity and/or execution of these General Conditions will be subject to the mandatory territorial jurisdiction of the judge of the place of residence or domicile of the Customer, if located in the Italian territory.
