6.2.

Rudy Perfumes accepts payments made with the following credit cards:

diners

6.3.

Transactions will be charged to the Customer's credit card only after:

(i) the credit card details have been verified;

(ii) the authorization to debit the card has been received by the issuer of the card used by the Customer, and

(iii) the availability of the Product has been confirmed by RUDY PROFUMI SRL and the order is therefore ready to be processed or the production material is in stock and RUDY PROFUMI SRL can start the production of the customized product.

6.4.

No charge will be made at the time of transmission of the order proposal, with the exception of the charge necessary to verify the validity of credit cards, if any.

6.5.

In the event that, for any reason, it is not possible to debit the amounts due by the Customer, the transaction will be interrupted and the sale canceled.

7. Conclusion of the contract

7.1.

The contract between RUDY PROFUMI SRL and the Customer is considered finalized when the Customer receives confirmation from RUDY PROFUMI SRL that his order proposal, transmitted through the procedure indicated on the Site, has been successfully concluded, once the availability of the Product or materials and the purchase price charged to the Customer's credit card or, in the case of payment by bank transfer, the receipt of the available funds transfer received by RUDY PROFUMI SRL has been confirmed. The Customer's order proposal will be binding for RUDY PROFUMI SRL when the purchase procedure on the Site is completed without errors.

7.2.

RUDY PROFUMI SRL reserves the right to partially fulfill any order proposal in the event that one or more of the Products ordered by the Customer are not available. In such cases, only the amount relating to the partially fulfilled order proposal will be charged.

7.3.

RUDY PROFUMI SRL is not responsible for errors due to the connection of the Customers to the Site.

7.4.

Upon confirmation of the order or execution of the contract, RUDY PROFUMI SRL will provide the Customer, by e-mail, with a summary of the General Conditions, information on the essential characteristics of the Products purchased, a detailed indication of the price and payment methods, information on delivery costs, information on the conditions and methods for exercising the right of withdrawal, including information on the exclusion of the right of withdrawal for customized Products, the address to which complaints can be addressed, information on assistance services and on existing commercial conditions. The Customer must immediately read this communication and immediately notify RUDY PROFUMI SRL of any errors or omissions.

8. Invalidity of the order proposal

8.1.

Without prejudice to the provisions of Paragraph 7 above, no order proposal will be considered accepted by RUDY PROFUMI SRL nor can any contract be concluded between RUDY PROFUMI SRL and the Customer if RUDY PROFUMI SRL has reasonable grounds to believe that the Customer:

(i) intends to purchase the Products for commercial or professional purposes;

(ii) is not a bona fide Customer; or

(iii) attempt to exercise the right of withdrawal in any illegitimate way.

8.2.

In such cases, the order proposal sent by the Customer will be void and will have no effect. RUDY PROFUMI SRL will communicate to the Customer, by e-mail, the non-acceptance of the order proposal and the non-conclusion of the contract and will also cancel any charge and / or charge against the Customer.

9. Transport and delivery

9.1.

For security reasons, the Products purchased on the Site will be delivered to the address registered on the credit card unless otherwise indicated by the Customer. At the time of delivery, the signature of the Customer or of an adult named adult will be required. RUDY PROFUMI SRL cannot deliver to post office boxes.

9.2.

In case of payment by bank transfer, deliveries will be made once the transfer in funds available from RUDY PROFUMI SRL has been received.

9.3.

For each order, RUDY PROFUMI SRL will invoice the Products via e-mail or post to the Customer. The invoice will be based on the information provided by the Customer when placing the order. No changes to the invoice are possible after it has been issued.

9.4.

Delivery costs are charged to the customer and are indicated separately in the order form and in the invoice.

9.5.

All purchases will be delivered by selected courier (eg UPS Express) (hereinafter, Courier) from Monday to Friday excluding Saturdays, Sundays and local or national holidays, starting from the day following the availability of the goods for shipment, based on of the indicated availability. RUDY PROFUMI SRL is not responsible for unpredictable delays and / or attributable exclusively to the Courier.

9.6.

In all cases, except for events beyond the reasonable control of RUDY PROFUMI SRL or unforeseeable circumstances, the Products must be delivered within 60 (sixty) days from the day following that of the conclusion of the contract referred to in the previous Paragraph 7.1, unless communicated by RUDY PROFUMI SRL Customer, also by e-mail, within the same term or within the deadline agreed for delivery, of the unavailability, even temporary, of the Products ordered. In this case RUDY PROFUMI SRL will reimburse any sums paid by the Customer in relation to the order.

9.7.

In the event that, following the communication of RUDY PROFUMI SRL of a delay in delivery, the Customer wishes to cancel the order, any amount already paid by the Customer will be refunded as soon as possible, in any case no later than. 30 (thirty) days from the date of receipt of the communication to the Customer of cancellation of the order, with the exception of customized Products, subject to the following Paragraph 12.

9.8.

The Customer or his delegate must be present at the delivery address indicated in the delivery order of the Products. Upon delivery of the Products by the Courier, the Customer is required to verify:

(i) that the number of items delivered corresponds to that indicated on the delivery note; is

(ii) that the packaging and its seals are intact, not damaged, not wet or otherwise altered. Any damage to the packaging and / or the Product, or discrepancies in the number of packages or in the documentation must be immediately reported in writing on the Courier's delivery note. Once the Courier's document has been signed and no objection from the Customer, the Customer will not be able to make any objection regarding the external characteristics of the delivered package.

10. Shipping and delivery confirmation

10.1.

RUDY PROFUMI SRL will send the Customer a confirmation e-mail once the Products have been shipped and a further communication once the Products have been delivered.

11. Packing or packing

11.1.

The products purchased on the Site are delivered with standard packaging.

12. Personalized products

12.1.

Pursuant to Legislative Decree n. 206 of the Consumer Code, the right of withdrawal, which would otherwise be available, does not apply to orders for customized Products, such as, for example, those with the Customer's initials engraved on the Product or pre-ordered products or customized products. The Customer is aware that the images on the Site do not necessarily correspond to reality: the images and photographs of the engraving may not reflect the real aspect of the final product. 13. Right of cancellation of orders

13.1.

RUDY PROFUMI SRL seeks the complete satisfaction of its customers. The Customer has the right to withdraw from the contract without specifying the reason, returning the Products purchased on the Site within 10 (ten) working days from the date of receipt of the Products. This applies to all Products other than customized ones, which are subject to Paragraph 12.

13.2.

To exercise the right of withdrawal, the Customer must send an e-mail to info@rudyprofumi.com:

indication of your intention to exercise the right of withdrawal;
the indication of the products for which the customer intends to exercise the right of withdrawal;

13.3.

With the exercise of the right of withdrawal, RUDY PROFUMI SRL will refund the full price of the Products on condition that they are returned by the Customer unworn, unused and undamaged, accompanied by the relative original invoice and the original RUDY PROFUMI SRL packaging. RUDY PROFUMI SRL will accept returns and exchanges of Products that have been delivered with a return / exchange label or sticker or seal only if the above return instructions are fully respected and the label or sticker or seal is intact and attached to the Product.

13.4.

RUDY PROFUMI SRL reserves the right to refuse returns of Products that do not comply with these requirements. In case of defective Products, the provisions of Paragraph 15 Lack of conformity apply. Refunds will be made with the same payment method used for the purchase.

13.5.

The costs of returning the Products are charged to the Customer. Any cost incurred by the Customer for returning the Products is non-refundable.

13.6.

Each delivery must contain, if possible, simple instructions for returning the Products.

13.7.

RUDY PROFUMI SRL undertakes to reimburse the Customer within 30 days from the date of receipt of the Customer's notice of cancellation of the order.

13.8.

Rudy Perfumes will send a notification email once the refund has been made.

13.9.

It is advisable to return the Products by courier, insuring the full value of the item and using a traceable shipping service. RUDY PROFUMI SRL cannot be held responsible for the reimbursement or compensation of Products returned but not received by RUDY PROFUMI SRL due to loss, theft or damage not attributable to RUDY PROFUMI SRL.

13.10.

If a customer wishes to modify or cancel an order already placed, he must immediately send an e-mail to info@rudyprofumi.com. This e-mail must be sent before the Customer receives confirmation of shipment from RUDY PROFUMI SRL.

13.11.

RUDY PROFUMI SRL will make every effort to satisfy the customer's request. However, once the Product has been shipped, the order cannot be canceled or modified. The Products shipped can in any case be returned as established in these General Conditions. This paragraph does not affect your statutory rights as a consumer.

14. Product Replacement

14.1.

RUDY PROFUMI SRL allows Customers to replace the Products purchased on the Site.

14.2.

To replace a Product purchased on the Site, Customers must follow the procedure indicated below.

14.3.

Customers who are not fully satisfied, or who believe there is a discrepancy in the order, must keep all the documentation relating to the delivery and to the Product itself in its original packaging, and immediately contact RUDY PROFUMI SRL by e-mail at info @ rudyprofumi .com, following the procedure referred to in paragraph 13 above.

14.4.

The Product to be replaced must be received by RUDY PROFUMI SRL in its original condition at the time of delivery, as provided for in Paragraph 13.3.

14.5.

As part of the replacement procedure, the amount paid by the Customer will be refunded in advance, through the payment system used by the Customer for the purchase, referred to in paragraph 6, before the new transaction can be made.

14.6.

To replace a Product, Customers must complete the form provided with each Product delivered, clearly indicating the code and size of the new Product that the Customer wishes to receive.

14.7.

The forwarding of the new order is subject to the availability of the requested Products.

14.8.

The delivery costs for returning the Product are charged to the Customer.

14.9.

In the event that the Customer requests the replacement due to lack of conformity pursuant to the following Paragraph 15, the replacement Product will be sent to the Customer by courier at no additional delivery cost. 15. Lack of conformity

15.1.

If a Product sold by RUDY PROFUMI SRL presents manufacturing defects or in any case alleged lack of conformity of the Products sold by RUDY PROFUMI SRL, the Customer must immediately contact the Online Assistance via email at info@rudyprofumi.com:

15.2.

The Customer has the right to bring the Products into compliance free of charge by repair or replacement, or, in the event of failure to comply with one of the above remedies, to an appropriate reduction in the price of the Products, or to terminate the contract.

16. Errors or inaccuracies

16.1.

RUDY PROFUMI SRL undertakes to provide updated information in the sections of the Site relating to the description and / or sale of the Products. However, RUDY PROFUMI SRL cannot guarantee that the Site is error-free. The Site in question may contain typing errors, inaccuracies or omissions, for example relating to the price or availability of the Product or to the information provided on the Product. 17. Guarantee of authenticity and intellectual property rights

17.2.

The RUDY PROFUMI SRL trademark, together with all the figurative and non-figurative trademarks, service marks, present in the Products, in the relative accessories and / or packaging, trademarks consisting of forms of goods, subject to registration or not, together with all the illustrations, images and places protected by copyright, and more generally all intellectual property rights relating to the Products, are and remain the exclusive property of RUDY PROFUMI SRL

18. Responsibility of RUDY PROFUMI SRL

18.1.

Without prejudice to Paragraph 18.2, RUDY PROFUMI SRL will not be liable under these General Conditions for any loss or damage caused by RUDY PROFUMI SRL or its employees or agents in the circumstances in which:

18.1.1.
there is no violation of a legal duty of care towards the Customer by RUDY PROFUMI SRL or any employee or agent of RUDY PROFUMI SRL;

18.1.2.
such loss or damage is not a reasonably foreseeable result of such breach and therefore is an indirect or consequential loss, and

18.1.3.
any increase in loss or damage derives from the violation by the Customer of any term of these General Conditions.

18.2.

Nothing in this agreement excludes or limits the liability of RUDY PROFUMI SRL for:

18.2.1.
death or personal injury caused by the negligence of RUDY PROFUMI SRL;

18.2.2.
fraud or fraudulent misrepresentation;

18.2.3.
any other matter for which it would be illegal for RUDY PROFUMI SRL to exclude or attempt to exclude its responsibility.

19. Applicable law and competent jurisdiction

19.1.

These General Conditions are governed by Legislative Decree no. 206 of 6 September 2005, Consumer Code "and Legislative Decree no. 70 of 9 April 2003, E-commerce Decree and must be interpreted in accordance with Italian laws.

19.2.

Any dispute arising from the interpretation, validity and / or execution of these General Conditions will be subject to the mandatory territorial jurisdiction of the competent Court of Florence, Italy.
